GENERAL TERMS AND CONDITIONS OF SALE \u2013 ONLINE STORE<\/h2>\n\n

These General Terms and Conditions of Sale (hereinafter the “Online Shop Terms and Conditions”) govern exclusively the sales of products made through the online shop operated by ProPixel on the website propixel.be<\/strong> .<\/p>\n\n

They apply to orders for standard and personalized products placed directly online by consumers or business customers.<\/p>\n\n

Professional services, sign projects, manufacturing on quote, installations, covering, signage and other services subject to a separate quote are subject to the General Terms and Conditions of Sale relating to ProPixel’s professional services and projects.<\/p>\n\n

By placing an order on the online store, the Customer acknowledges having read and accepted these Terms and Conditions, subject to applicable mandatory legal provisions.<\/p>\n\n

Hereinafter referred to as “ProPixel”.<\/p>\n\n

2. PURPOSE OF THESE CONDITIONS<\/h2>\n\n

These Terms and Conditions apply exclusively to products offered for sale directly on the ProPixel online store.<\/p>\n\n

The products offered may include, but are not limited to:<\/p>\n\n

  • plaques and communication supports;<\/li>\n
  • QR Code plaques;<\/li>\n
  • business cards;<\/li>\n
  • vinyl printing;<\/li>\n
  • advertising materials;<\/li>\n
  • paintings and decorative creations;<\/li>\n
  • standard products;<\/li>\n
  • customized products;<\/li>\n
  • products made from photographs provided by the Client;<\/li>\n
  • artistic creations;<\/li>\n
  • creations assisted by artificial intelligence;<\/li>\n
  • and any other product featured in the online store.<\/li>\n<\/ul>\n\n

    The characteristics, options, dimensions, materials, finishes and customization possibilities specific to each product are indicated on its product sheet or in the ordering process.<\/p>\n\n

    \n\n

    3. CUSTOMERS CONCERNED<\/h2>\n\n

    The online store can be used by:<\/p>\n\n

      \n
    • consumers acting for private purposes;<\/li>\n
    • companies and self-employed individuals acting within the scope of their professional activity.<\/li>\n<\/ul>\n\n

      When the Client acts as a consumer, the mandatory provisions of Belgian and European law relating to consumer protection apply.<\/p>\n\n

      When the Client acts within the scope of their professional activity, the provisions applicable to business-to-business relationships apply.<\/p>\n\n

      \n\n

      4. PRODUCTS<\/h2>\n\n

      ProPixel takes reasonable care in the presentation of the products offered on the online store.<\/p>\n\n

      The photographs, illustrations, digital representations and simulations presented on the site are intended, in particular, to allow the Customer to visualize the product.<\/p>\n\n

      Slight differences may exist between the on-screen representation and the physical product, particularly due to:<\/p>\n\n

        \n
      • screen display settings;<\/li>\n
      • brightness;<\/li>\n
      • lighting conditions;<\/li>\n
      • materials used;<\/li>\n
      • printing processes;<\/li>\n
      • finishing touches;<\/li>\n
      • normal manufacturing tolerances.<\/li>\n<\/ul>\n\n

        These differences do not deprive the consumer of their legal rights regarding conformity when the essential characteristics of the product do not correspond to those agreed upon.<\/p>\n\n

        5. CUSTOMIZED PRODUCTS<\/h2>\n\n

        Some products are made according to the Client’s specifications or are clearly personalized.<\/p>\n\n

        Customization can include, in particular:<\/p>\n\n

          \n
        • the text;<\/li>\n
        • the dimensions;<\/li>\n
        • the colours;<\/li>\n
        • the photographs;<\/li>\n
        • the logos;<\/li>\n
        • QR Codes;<\/li>\n
        • the illustrations;<\/li>\n
        • the materials;<\/li>\n
        • the finishing touches;<\/li>\n
        • graphic composition;<\/li>\n
        • or any other item offered during the ordering process.<\/li>\n<\/ul>\n\n

          The Customer is responsible for carefully checking the information they enter before confirming their order.<\/p>\n\n

          An error introduced by the Customer during personalization, including a spelling mistake, wrong number, wrong address, wrong photograph or wrong file, can be reproduced according to the information provided by the Customer.<\/p>\n\n

          This provision does not limit the consumer’s legal rights when an error is attributable to ProPixel or when the product does not conform to the order.<\/p>\n\n

          \n\n

          6. PHOTOGRAPHS PROVIDED BY THE CLIENT<\/h2>\n\n

          When the Customer provides a photograph to create a personalized product, they guarantee that they have the necessary rights and authorizations to allow ProPixel to process this photograph as part of the order.<\/p>\n\n

          The Client is specifically responsible for obtaining, where necessary, the relevant authorizations:<\/p>\n\n

            \n
          • to the right to the image of the people depicted;<\/li>\n
          • to copyright;<\/li>\n
          • to the rights of photographers;<\/li>\n
          • to the rights of trademarks or other protected elements present in the image.<\/li>\n<\/ul>\n\n

            ProPixel may refuse a photograph or content whose use appears likely to infringe the rights of a third party or applicable legislation.<\/p>\n\n

            \n\n

            7. ARTIFICIAL INTELLIGENCE-ASSISTED CREATIONS<\/h2>\n\n

            Some products can be created or transformed using generative artificial intelligence technologies.<\/p>\n\n

            These technologies can be used, in particular, for:<\/p>\n\n

              \n
            • transform a photograph;<\/li>\n
            • create an illustration;<\/li>\n
            • modify a setting;<\/li>\n
            • modifying clothes or accessories;<\/li>\n
            • generate visual effects;<\/li>\n
            • to create an artistic composition;<\/li>\n
            • adapt an image to a print format;<\/li>\n
            • or perform certain retouching operations.<\/li>\n<\/ul>\n\n

              The generated creations can then be selected, corrected, retouched, composed or prepared by ProPixel before their production.<\/p>\n\n

              Due to the nature of generative artificial intelligence technologies, the result may present some differences compared to the photograph or instructions initially provided.<\/p>\n\n

              When applicable regulations require information regarding the nature of content generated or manipulated by artificial intelligence, ProPixel provides this information according to the required terms.<\/p>\n\n

              \n\n

              8. USE OF PHOTOGRAPHS FOR AI CREATIONS<\/h2>\n\n

              When a photograph is provided to create a personalized product, ProPixel may process it to the extent necessary to fulfill the order.<\/p>\n\n

              The treatment may include, in particular:<\/p>\n\n

                \n
              • image analysis;<\/li>\n
              • file preparation;<\/li>\n
              • the transformation;<\/li>\n
              • image generation;<\/li>\n
              • retouching;<\/li>\n
              • the composition;<\/li>\n
              • preparation for printing;<\/li>\n
              • quality control;<\/li>\n
              • after-sales service.<\/li>\n<\/ul>\n\n

                When certain processing operations require the use of external service providers or technical tools, data may be transmitted to these providers to the extent necessary for the execution of the order and in accordance with applicable data protection regulations.<\/p>\n\n

                The detailed terms and conditions for the processing of personal data are specified in ProPixel’s Privacy Policy.<\/p>\n\n

                \n\n

                9. PRODUCT AVAILABILITY<\/h2>\n\n

                Products are offered subject to availability.<\/p>\n\n

                In the event of exceptional unavailability of a product after the order has been placed, ProPixel will inform the Customer as soon as possible.<\/p>\n\n

                When the order cannot be executed due to this unavailability, ProPixel will refund the amounts concerned in accordance with the applicable regulations.<\/p>\n\n

                \n\n

                10. PRICE<\/h2>\n\n

                Prices are shown in euros.<\/p>\n\n

                For consumers, the prices displayed are indicated in accordance with applicable price information rules and include applicable taxes, unless otherwise required by regulation.<\/p>\n\n

                Any delivery charges or additional fees are indicated before final order confirmation.<\/p>\n\n

                The applicable price is the one displayed at the time of order confirmation, subject to obvious error.<\/p>\n\n

                11. ORDERS<\/h2>\n\n

                The Customer selects the product(s) they wish to order and provides the information necessary to process the order.<\/p>\n\n

                Before final validation, the Client can check, in particular:<\/p>\n\n

                  \n
                • the selected products;<\/li>\n
                • the options;<\/li>\n
                • the quantities;<\/li>\n
                • customization options;<\/li>\n
                • the delivery address;<\/li>\n
                • delivery costs;<\/li>\n
                • the total amount of the order.<\/li>\n<\/ul>\n\n

                  The Customer must correct any errors before definitively validating their order.<\/p>\n\n

                  The order becomes final when the Customer validates the order process and performs the action indicated on the site as resulting in an obligation to pay.<\/p>\n\n

                  \n\n

                  12. OBLIGATION TO PAY<\/h2>\n\n

                  When the order involves an obligation to pay, the Customer is clearly informed before its final validation.<\/p>\n\n

                  The button or function enabling the order to be finalized must clearly indicate that the order entails an obligation to pay, in accordance with applicable legal requirements.<\/p>\n\n

                  An order that is not validly confirmed or for which payment is not authorized may not be processed.<\/p>\n\n

                  13. METHODS OF PAYMENT<\/h2>\n\n

                  The available payment methods are those offered during the ordering process.<\/p>\n\n

                  ProPixel may change the payment methods available for future orders.<\/p>\n\n

                  The Customer cannot be charged additional fees related to the use of a payment method when applicable regulations prohibit such fees.<\/p>\n\n

                  14. ORDER CONFIRMATION<\/h2>\n\n

                  After validation of the order, ProPixel sends the Customer an order confirmation on a durable medium, in particular by email when this address has been provided.<\/p>\n\n

                  The confirmation may include, in particular:<\/p>\n\n

                    \n
                  • the order number;<\/li>\n
                  • the products ordered;<\/li>\n
                  • options and customizations;<\/li>\n
                  • the price;<\/li>\n
                  • delivery costs;<\/li>\n
                  • the delivery address;<\/li>\n
                  • Information useful for order tracking.<\/li>\n<\/ul>\n\n
                    \n\n

                    15. DELIVERY<\/h2>\n\n

                    Products ordered online are delivered according to the terms offered during the ordering process.<\/p>\n\n

                    Any delivery restrictions and accepted payment methods are communicated to the Customer in accordance with applicable legal obligations.<\/p>\n\n

                    The delivery times indicated at the time of ordering are those applicable to the order in question, subject to circumstances beyond the reasonable control of ProPixel and applicable legal rules.<\/p>\n\n

                    When no other deadline has been agreed, the statutory deadlines applicable to distance sales apply.<\/p>\n\n

                    \n\n

                    16. DELIVERY DELAY OR PROBLEM<\/h2>\n\n

                    In the event of a significant delay or problem concerning delivery, the Customer can contact ProPixel at the following address:<\/p>\n\n

                    ProPixel is reviewing the situation and taking appropriate action in accordance with its legal obligations.<\/p>\n\n

                    For consumers, the risk of loss or damage to the goods remains, in principle, with ProPixel until physical possession of the goods is taken by the consumer or by the third party designated by the consumer.<\/p>\n\n

                    \n\n

                    17. DELIVERY COSTS<\/h2>\n\n

                    The applicable delivery charges are indicated to the Customer before final order confirmation.<\/p>\n\n

                    Any mandatory additional costs must be communicated in accordance with the applicable rules regarding pre-contractual information.<\/p>\n\n

                    When the Customer validly exercises their right of withdrawal, delivery costs are refunded in accordance with applicable legal rules.<\/p>\n\n

                    \n\n

                    18. RIGHT OF WITHDRAWAL<\/h2>\n\n

                    For contracts concluded remotely with a consumer, the latter generally has a right of withdrawal of 14 calendar days<\/strong> , subject to the exceptions provided for by law.<\/p>\n\n

                    The Client does not have to justify their decision to withdraw.<\/p>\n\n

                    The right of withdrawal must be exercised within the applicable legal period.<\/p>\n\n

                    The Customer may exercise their right of withdrawal by sending a clear statement expressing their decision to withdraw to:<\/p>\n\n

                    The Customer may also use the legal model withdrawal form where applicable.<\/p>\n\n

                    19. STARTING POINT OF THE WITHDRAWAL PERIOD<\/h2>\n\n

                    For a sale of goods, the withdrawal period begins in accordance with the applicable legal rules, in particular from the date of physical possession of the goods by the consumer or by the third party designated by the consumer.<\/p>\n\n

                    When the order includes several goods delivered separately, the legal rules relating to the starting point of the period apply.<\/p>\n\n

                    \n\n

                    20. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL<\/h2>\n\n

                    The right of withdrawal does not apply in situations expressly provided for by the regulations.<\/p>\n\n

                    This exception may notably concern goods made to the consumer’s specifications or clearly personalized.<\/p>\n\n

                    It can also concern other categories of property or situations provided for by law.<\/p>\n\n

                    When the right of withdrawal is excluded for a product, this information is communicated to the Customer before the conclusion of the order when required by regulations.<\/p>\n\n

                    \n\n

                    21. PERSONALIZED PRODUCTS AND RETURNS<\/h2>\n\n

                    When a product is manufactured according to the Customer’s specifications or is clearly personalized, the right of withdrawal may be legally excluded.<\/p>\n\n

                    This exclusion applies in particular to products manufactured specifically from information, photographs, texts, dimensions or other elements chosen by the Customer when the legal conditions of the exception are met.<\/p>\n\n

                    This exclusion does not apply in such a way as to eliminate the legal guarantee of conformity or the consumer’s rights in the event of a defect or error attributable to ProPixel.<\/p>\n\n

                    \n\n

                    22. RETURN AFTER WITHDRAWAL<\/h2>\n\n

                    When the right of withdrawal is applicable and validly exercised, the Customer must return the goods in accordance with the instructions provided by ProPixel.<\/p>\n\n

                    Unless ProPixel agrees to take responsibility for them or the law provides otherwise, the direct costs of return may be borne by the Customer.<\/p>\n\n

                    The Customer must take reasonable care of the product during the period in which it is in their possession.<\/p>\n\n

                    In accordance with applicable regulations, the Client may be held liable for any depreciation of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and proper functioning of the goods.<\/p>\n\n

                    \n\n

                    23. REFUND<\/h2>\n\n

                    When the Customer validly exercises their right of withdrawal, ProPixel will reimburse the amounts due in accordance with the time limits and procedures provided for by the applicable regulations.<\/p>\n\n

                    The refund is made in principle using the same payment method as that used during the initial transaction, unless otherwise agreed or legally or technically impossible.<\/p>\n\n

                    ProPixel may defer reimbursement until the goods are recovered or until the Customer provides proof of shipment, depending on the situation and in accordance with applicable legal rules.<\/p>\n\n

                    \n\n

                    24. LEGAL GUARANTEE OF CONFORMITY<\/h2>\n\n

                    Products sold to consumers are covered by the applicable legal guarantee of conformity.<\/p>\n\n

                    For new consumer goods, the legal guarantee is in principle two years from the date of delivery of the goods<\/strong> , in accordance with applicable regulations.<\/p>\n\n

                    The consumer must inform ProPixel of the defect as soon as possible and, in any event, within the applicable legal time limit, in particular within two months of the discovery of the defect<\/strong> .<\/p>\n\n

                    The statutory guarantee cannot be waived or limited by these Terms and Conditions.<\/p>\n\n

                    \n\n

                    25. DEFECTIVE OR NON-CONFORMING PRODUCTS<\/h2>\n\n

                    When a product has a non-conformity or does not correspond to the order, the Customer must contact ProPixel to allow the situation to be examined.<\/p>\n\n

                    The Client can contact:<\/p>\n\n

                    info@propixel.be<\/strong><\/p>\n\n

                    It is recommended to provide:<\/p>\n\n

                      \n
                    • the order number;<\/li>\n
                    • a description of the problem;<\/li>\n
                    • photographs when these illustrate the defect;<\/li>\n
                    • any information useful for processing the claim.<\/li>\n<\/ul>\n\n

                      ProPixel processes the request in accordance with the consumer’s legal rights.<\/p>\n\n

                      \n\n

                      26. COMMERCIAL WARRANTY<\/h2>\n\n

                      When an additional commercial warranty is offered for a product, its specific conditions are indicated on the product sheet, in the order or in a document given to the Customer.<\/p>\n\n

                      Any commercial warranty is in addition to the legal warranty and cannot have the effect of reducing the consumer’s legal rights.<\/p>\n\n

                      \n\n

                      27. COMPLAINTS<\/h2>\n\n

                      Any complaint can be addressed to:<\/p>\n\n

                      info@propixel.be<\/strong><\/p>\n\n

                      To facilitate the processing of the request, the Client is asked to indicate:<\/p>\n\n

                        \n
                      • his name;<\/li>\n
                      • his order number;<\/li>\n
                      • the date of the order;<\/li>\n
                      • the product in question;<\/li>\n
                      • the nature of the problem;<\/li>\n
                      • photographs or useful documents.<\/li>\n<\/ul>\n\n

                        ProPixel reviews complaints as quickly as possible.<\/p>\n\n

                        \n\n

                        28. PERSONALIZATION ERRORS ATTRIBUTABLE TO THE CUSTOMER<\/h2>\n\n

                        When a product is manufactured according to information entered and validated by the Customer, ProPixel cannot be held responsible for an error arising directly from this information.<\/p>\n\n

                        This includes, in particular:<\/p>\n\n

                          \n
                        • a spelling mistake introduced by the Client;<\/li>\n
                        • a bad number;<\/li>\n
                        • a bad address;<\/li>\n
                        • a faulty link or QR Code provided by the Client;<\/li>\n
                        • a bad photograph;<\/li>\n
                        • a bad logo;<\/li>\n
                        • The wrong size was selected by the customer.<\/li>\n<\/ul>\n\n

                          This clause does not apply when an error has been introduced by ProPixel or when the product does not correspond to the information actually validated by the Client.<\/p>\n\n

                          \n\n

                          29. QR CODES AND LINKS PROVIDED BY THE CLIENT<\/h2>\n\n

                          When the Client provides a link, URL, content or destination for the creation of a QR Code, they are responsible for verifying its accuracy before validating the order.<\/p>\n\n

                          ProPixel cannot be held responsible for the subsequent unavailability of a website, page, account or external service to which the QR Code directs when this unavailability is independent of ProPixel.<\/p>\n\n

                          When ProPixel generates the QR Code from the information provided by the Client, the Client is invited to check its functionality before validation when a preview or validation is offered.<\/p>\n\n

                          \n\n

                          30. INTELLECTUAL PROPERTY RIGHTS<\/h2>\n\n

                          The Client retains ownership of the rights he holds over the content he provides.<\/p>\n\n

                          The Client guarantees that they have the necessary rights to allow ProPixel to use this content in connection with the order.<\/p>\n\n

                          The creations, compositions, illustrations, graphic files, visual elements and other content developed by ProPixel remain protected by applicable intellectual property rights, unless expressly assigned or licensed.<\/p>\n\n

                          Payment for a product does not automatically constitute a transfer of all intellectual property rights to the source files or creative elements used for its production.<\/p>\n\n

                          \n\n

                          31. ILLEGAL CONTENT OR CONTENT INFRINGING ON THE RIGHTS OF THIRD PARTIES<\/h2>\n\n

                          ProPixel may refuse an order containing content that is manifestly illegal, hateful, violent, defamatory, pornographic, infringing or likely to seriously infringe the rights of a third party.<\/p>\n\n

                          The Client remains responsible for the content they request to be reproduced on a product.<\/p>\n\n

                          ProPixel may suspend processing of an order when further verification is required regarding the rights or legality of the content provided.<\/p>\n\n

                          \n\n

                          32. USE OF PERSONAL DATA<\/h2>\n\n

                          ProPixel processes personal data necessary for the operation of the store and the execution of orders in accordance with the General Data Protection Regulation (GDPR) and applicable legislation.<\/p>\n\n

                          The data can be used, in particular, for:<\/p>\n\n

                            \n
                          • create and manage a customer account;<\/li>\n
                          • process an order;<\/li>\n
                          • make a payment;<\/li>\n
                          • prepare and manufacture a product;<\/li>\n
                          • arrange the delivery;<\/li>\n
                          • contact the Customer regarding their order;<\/li>\n
                          • handle complaints;<\/li>\n
                          • to provide after-sales service;<\/li>\n
                          • to comply with legal obligations.<\/li>\n<\/ul>\n\n

                            The detailed terms of data processing are specified in ProPixel’s Privacy Policy<\/strong> .<\/p>\n\n

                            \n\n

                            33. PRESERVATION OF PROVIDED PHOTOGRAPHS<\/h2>\n\n

                            Photographs provided by the Client may be kept for the time necessary to process the order and to handle any claims, guarantees or legal obligations.<\/p>\n\n

                            The retention periods and precise processing methods are detailed in the Privacy Policy.<\/p>\n\n

                            ProPixel does not automatically use photographs provided by Clients for advertising or promotional purposes.<\/p>\n\n

                            \n\n

                            34. USE OF ORDERS FOR PROMOTIONAL PURPOSES<\/h2>\n\n

                            A custom creation made for a Client cannot be used for promotional purposes or published as a work featuring an identifiable person when this requires authorization that has not been obtained.<\/p>\n\n

                            When ProPixel wishes to use a photograph or a custom creation for promotional purposes and authorization is required, separate authorization may be requested from the Client.<\/p>\n\n

                            \n\n

                            35. CUSTOMER ACCOUNTS<\/h2>\n\n

                            When the store allows the creation of a customer account, the Customer is responsible for the accuracy of the information provided and the confidentiality of their login details.<\/p>\n\n

                            The Client must inform ProPixel without delay in the event of unauthorized use of their account as soon as they become aware of it.<\/p>\n\n

                            ProPixel may suspend or deactivate an account in the event of fraudulent, abusive use or use contrary to these Terms and Conditions, subject to the Client’s legal rights.<\/p>\n\n

                            \n\n

                            36. TECHNICAL PROBLEMS<\/h2>\n\n

                            ProPixel implements reasonable measures to ensure the proper functioning of its online store.<\/p>\n\n

                            Temporary interruptions may nevertheless occur, particularly due to:<\/p>\n\n

                              \n
                            • maintenance operations;<\/li>\n
                            • updates;<\/li>\n
                            • technical problems;<\/li>\n
                            • of service provider failures;<\/li>\n
                            • security incidents;<\/li>\n
                            • or circumstances beyond ProPixel’s reasonable control.<\/li>\n<\/ul>\n\n

                              A temporary unavailability of the site does not affect the Client’s legal rights regarding an order already validly concluded.<\/p>\n\n

                              \n\n

                              37. PROPIXEL’S LIABILITY<\/h2>\n\n

                              ProPixel is responsible for fulfilling its obligations in accordance with applicable regulations.<\/p>\n\n

                              ProPixel cannot be held responsible for consequences directly attributable to:<\/p>\n\n

                                \n
                              • to erroneous information provided by the Client;<\/li>\n
                              • to a file provided by the Client;<\/li>\n
                              • to a photograph provided by the Client;<\/li>\n
                              • to an incorrect link or QR Code provided by the Client;<\/li>\n
                              • to improper use of the product;<\/li>\n
                              • to a modification of the product carried out by a third party;<\/li>\n
                              • due to the unavailability of an external service independent of ProPixel;<\/li>\n

                                38. FORCE MAJEURE<\/h2>\n\n

                                ProPixel cannot be held responsible for any delay or inability to perform resulting from an event beyond its control and reasonably unforeseeable or unavoidable.<\/p>\n\n

                                The following may be affected, depending on the circumstances:<\/p>\n\n

                                  \n
                                • natural disasters;<\/li>\n
                                • fires;<\/li>\n
                                • major breakdowns;<\/li>\n
                                • exceptional interruption of supply;<\/li>\n
                                • unavailability of materials;<\/li>\n
                                • major transport problems;<\/li>\n
                                • administrative decisions;<\/li>\n
                                • major technical incidents;<\/li>\n
                                • major cyber incidents;<\/li>\n
                                • exceptional unavailability of a supplier or service provider.<\/li>\n<\/ul>\n\n
                                  \n\n

                                  39. SUBCONTRACTORS AND SERVICE PROVIDERS<\/h2>\n\n

                                  ProPixel may use technical service providers, manufacturers, printers, carriers, payment services, hosting services or other suppliers necessary to execute an order.<\/p>\n\n

                                  When these service providers process personal data on behalf of ProPixel, the applicable data protection requirements are complied with.<\/p>\n\n

                                  \n\n

                                  40. MODIFICATION OF PRODUCTS AND THE CATALOGUE<\/h2>\n\n

                                  ProPixel may modify, replace or remove products offered in its online store.<\/p>\n\n

                                  These modifications do not invalidate orders already validly concluded, except when execution becomes impossible under the conditions provided for by law.<\/p>\n\n

                                  \n\n

                                  41. CANCELLATION OF A PROPIXEL ORDER<\/h2>\n\n

                                  ProPixel may exceptionally cancel an order when it cannot reasonably be executed, particularly in the following cases:<\/p>\n\n

                                  • of permanent unavailability of the product;<\/li>\n
                                  • obvious pricing error;<\/li>\n
                                  • of major technical impossibility;<\/li>\n
                                  • reasonable suspicion of fraud;<\/li>\n
                                  • of manifestly illegal content or content that infringes on the rights of a third party;<\/li>\n
                                  • or any other legitimate circumstance preventing the execution of the order.<\/li>\n<\/ul>\n\n

                                    When ProPixel cancels an order that has already been paid for, the amounts owed to the Customer are refunded in accordance with applicable regulations.<\/p>\n\n

                                    \n\n

                                    42. LATE PAYMENTS \u2013 BUSINESS CLIENTS<\/h2>\n\n

                                    When the online store accepts orders from business customers with deferred payment, the payment terms indicated at the time of ordering or on the invoice apply.<\/p>\n\n

                                    In the event of late payment, ProPixel may apply the interest and compensation provided for in the contract and by applicable legislation.<\/p>\n\n

                                    \n\n

                                    43. ELECTRONIC EVIDENCE<\/h2>\n\n

                                    Electronic records kept by ProPixel, including order confirmations, order data, electronic exchanges and payment data, may be used as evidence of transactions carried out, subject to applicable legal rules.<\/p>\n\n

                                    The Client acknowledges the probative value of electronic communications within the limits provided by law.<\/p>\n\n

                                    For consumer disputes, the Customer may also use the out-of-court dispute resolution mechanisms available in accordance with applicable Belgian regulations.<\/p>\n\n

                                    These GTC are governed by Belgian law.<\/p>\n\n

                                    For consumers, the application of Belgian law cannot have the effect of depriving them of the mandatory protections granted to them by the applicable legal provisions.<\/p>\n\n

                                    47. JURISDICTION<\/h2>\n\n

                                    In the event of a dispute, the parties are encouraged to first seek an amicable solution.<\/p>\n\n

                                    In the absence of an amicable agreement, the competent jurisdictions are determined in accordance with the applicable legal rules.<\/p>\n\n

                                    For consumers, no clause in these Terms and Conditions may have the effect of removing the mandatory rules of jurisdictional competence which apply to them.<\/p>\n\n

                                    48. MODIFICATION OF GENERAL TERMS AND CONDITIONS<\/h2>\n\n

                                    ProPixel may modify these Terms and Conditions to take into account, in particular:<\/p>\n\n

                                    • of the evolution of its products;<\/li>\n
                                    • the evolution of its services;<\/li>\n
                                    • of the evolution of its operation;<\/li>\n
                                    • the evolution of the technical means used;<\/li>\n
                                    • of the evolution of applicable regulations.<\/li>\n<\/ul>\n\n

                                      The version applicable to an order is the one in effect at the time the contract was concluded.<\/p>\n\n

                                      Subsequent modifications do not apply retroactively to orders already concluded.<\/p>\n\n

                                      49. PARTIAL NULLITY<\/h2>\n\n

                                      If any provision of these Terms and Conditions is declared invalid or unenforceable, the other provisions shall remain applicable to the extent permitted by law.<\/p>\n\n
